From The Arizona Daily Star: The U.S. Circuit Court of Appeals, overturning a lower court decision, has reinstated judicial supervision of the Tucson (Ariz.) school district's efforts to desegregate its schools. The opinion calls the decision to terminate the desegregation order "clearly erroneous." Black and Hispanic plaintiffs, as well as the U.S. Justice Department, had argued that a U.S. District Court judge erred in granting Tucson so-called "unitary status." The district has had to abide by a federally enforced desegregation order since 1978, when it settled a race discrimination lawsuit brought by minority students.
