Colorado will appeal court ruling on school finance

Dec. 29, 2011
Judge declared state's education funding violates Colorado constitution

From The Denver Post: The Colorado board of education will appeal a court ruling that called school funding in the state "unconscionable." The state board voted 4-3. The board also voted 4-3 for having state education commissioner Robert Hammond proceed with his own appeal of the case. Gov. John Hickenlooper will also appeal the case. The case named three defendants — Hickelooper, the state board of education and the education commissioner. Each has the authority to decide to appeal or not. Judge Sheila Rappaport ruled on Dec. 9 that the state is not meeting the Colorado Constitution's requirement of a "thorough and uniform" public education system.

Earlier...from The Denver Post: A judge has ruled that Colorado's school funding system is not "thorough and uniform" as mandated by the state constitution. The state's school funding system "is not rationally related to the mandate to establish and maintain a thorough and uniform system of free public schools," District Judge Sheila Rappaport says in her 183-page ruling. The lawsuit seeks no specific sum of money, but plaintiffs have pointed to studies estimating the state is underfunding education by as much as $4 billion.
