Panel says deed restriction doesn't prohibit Bloomfield Hills from leasing building to Waterford district
From The Detroit Free Press: A Michigan Court of Appeals panel has ruled that the Bloomfield Hills board can lease the Pine Lake Elementary School building to the Waterford School District without violating a 1955 deed restriction. The judges say the deed limits the ownership of the 11.72 acres to the Bloomfield Hills school district and that the property can be used for only a school. However, the justices rejected the argument that the district's use of the land is restricted solely to students of the district.August 2009...from The Detroit Free Press: The Bloomfield Hills (Mich.) school district plans to challenge a judge's order requiring it to evict disabled students from Waterford who are attending classes in a building rented from the district. Oakland County Circuit Judge Michael Warren ruled that the district violated a charitable trust set forth after the previous owner of Pine Lake Elementary School's 11.7-acre site granted the property to the district in 1955 on the condition that it be used as a school only for students in the district.
