Homeowners in Wisconsin sue in effort to join different school district

The group seeks to leave the West Allis-West Milwaukee District and join the neighboring New Berlin School District.

A group of New Berlin, Wisconsin, homeowners in the West Allis-West Milwaukee School District is suing the district in an attempt to detach from that district and join the neighboring New Berlin School District.

The Milwaukee Journal Sentinel reports that the group filed the suit after the West Allis-West Milwaukee School District declared its detachment petition invalid.

The lawsuit asserts the West Allis-West Milwaukee School District is trying to silence the petitioners, and said the school district failed to provide any written description of the procedures for school district reorganization, as required by state law.

Additionally, it argues that there's precedent for homes detaching from the West Allis-West Milwaukee School District and attaching to the New Berlin School District. In 2023, the School District Boundary Appeal Board, which is within the state Department of Public Instruction, approved a petition to move 161 homes from the West Allis-West Milwaukee School District to the New Berlin School District.
